BACKGROUND

The "Agricultural Pollution Control Project" is implemented under a Grant Agreement,
with a value of 5.15 mills. US$, concluded between the Government of Romania,
represented by the Ministry of Public Finance, and the International Bank for
Reconstruction and Development acting as implementing agency for the Global
Environment Fund, signed on 16 January 2002, at Bucharest and approved by
Government Emergency Ordinance no. 19 from 4 March 2002.

The Project is a demonstration activity having as the general objective to significantly
increase the use of environmental friendly agricultural practices, in the area of 7
communes1 from Clrai County, for reducing the discharge of nutrients from
agricultural sources from Romania, into the Danube and the Black Sea.

This Report presents in a succinct way, the main achievements in Project implementation
in the period between 01.07.2005 and 31.12.2005, the problems met, the actions
undertaken for their settlement and the next steps for 2006.

By end May 2005, the Project Implementation Plan for year 2005 has been updated
according to the progress achieved and the requests received from the local stakeholders.
The updated Implementation Plan has been approved during the meeting of the Local
Coordination Committee from 27 May 2005 (Annex 1).

Component 1: Activities in Clrai County


A. Manure management. This sub-component provided grants, to the seven Project
communes, for construction of 14 commune level manure management platforms having
the storage capacity between 2,400 and 4,100 tons and of 2251 individual (household)
platforms. Also, the Project provided training and community awareness sessions
regarding the good manure collection and management practices including composting,
testing and application on lands as organic fertilizer.

For the reporting period, the key aspects related to the implementation of this component
were:
a. Final reception of the commune platforms constructed in 2004.
b. Supplementing the number of euro-bins provided for separated collection of
household waste;
c. Continuing the training of the specialists from the communes, regarding the
operation means of the commune level manure management facilities;
d. Providing small equipment for controlling and conducting the composting
process.
e. Construction of access roads to the platforms ­ communes' contribution.
f. Tree planting around completed platforms.

The commune level manure management facilities constructed by end 2004 were
periodically inspected following up their behavior under exploitation. At the end of the
warranty period of one year, the final reception has been done for the last 6 commune
level platforms, the reception Commission ascertaining the good functioning of these
investments and admitting their final reception without further observations.

Regarding the segregation of the household waste, a number of 2,100 euro-bins were
purchased according with the agreed procedures, and distributed to the communes. The
procurement procedure was started in June 2005 and was completed by early September
2005. Each commune received a number of 300 bins to be distributed to the households
that have animals but did not received an individual manure platform, in order to
facilitate the collection of manure without household waste, and which may be accepted
at the commune level manure storage platform.

The small equipment for controlling and conducting the composting process is destined
to the 15 manure management facilities built in the Project area and consists of 15
electric drainage pumps and 15 electric generators. The electric groups are destined to
ensure the electricity source at the manure storage, both for lighting and equipment, and
this was a requirement of the Environmental Permit issued by the EPA Calarasi while the
drainage pumps will be used for empting the liquid fraction from the storage tanks and
watering the manure piles for ensuring the composting conditions. The equipment was
purchased and transferred to the communes in December 2005.

The construction/rehabilitation of the access roads to the platforms represents the
communes' contribution to the Project. For the communes Cuza Voda and Independenta,
the World Bank's Rural Development Project has considered the possibility of financing
from their resources the construction of some sections of the roads. Finally, for the
Independenta commune the roads to the platforms were included in the RDP technical
documentation.
By the end of 2006, there were rehabilitated the access roads to the platforms, in
Valcelele and Independenta communes, for a length of about 750 m.

Also, the communes continued with the plantation of trees as forest belts around the
platforms in view of improving the landscape, protect the platform from snow and
retaining the dust and small waste particles carried by the wind. The saplings were
provided by the Project and the work was the communes' contribution. Due to the fact
that some of the platforms were built over the former unauthorized piles of mixed waste
(containing large quantities of concrete, glass, bricks, scrap iron etc.), the success rate of
the tree planting is small and for this reason some tree replacements were necessary. The
tree planting has been achieved by the majority of the communes. For better results the
activity must be continued during the following years.

Two of the seven communes from the Project area, have opened centralized services for
waste management, at the entire community level. Based on their experience, the other
communes will follow as such.




B. Testing/Demonstration of the environment friendly agricultural practices.

The main activities for this component for year 2005 consisted of:
- Tree planting on the degraded lands on the terrace areas and some limited
areas in Boianu-Sticleanu and Calarasi-Raul polders;
- Demonstrations regarding the efficient rehabilitation of the unauthorized
waste platforms;
- Collaboration with the "Agricultural Services Support" Project (ASSP),
under the "Competitive Grant Scheme"; Monitoring and finalizing the
financing of the projects under the Competitive Grant Scheme;
- Pastures rehabilitation and grazing management;
- Demonstrations regarding the management of the nutrients at the farm
level.

The tree planting activity on degraded lands started in 2002 has been continued according
with the implementation schedule. There were delivered saplings of poplar, acacia, honey
locust and willow, to a number of 8 communes and one agricultural society, located in
Boianu-Sticleanu Polder. The areas planted with trees during autumn 2005, are of
approximately 49 ha. The situation regarding the planting supported through the
campaign carried-out under the Agricultural Pollution Control Project is according to the
attached table.

With regards to the rehabilitation of the old unauthorized waste platforms, the
rehabilitation project was analyzed by the Project Local Coordination Committee which
decided for a minimal program which will meet the Project funds. If the beneficiary
communes may co-finance this activity, they can extend the program accordingly.
With a demonstrational purpose, there were rehabilitated a number of seven unauthorized
waste platforms, one in each commune. The waste spread over large surfaces of
agricultural land was and organized in shaped piles that finally will be surrounded with
tree belts or planted with trees for landscape improvement and prevention of the further
use as an unauthorized dumping place for waste.

Regarding the Competitive Grant Scheme within the "Agricultural Services Support"
Project (ASSP), a number of three sub-projects having as object the promotion of
environmental friendly agricultural practices, were co-financed. The PMU, in
collaboration with the ASSP specialists, has permanently monitored the implementation
of these sub-projects and the last trances have been paid.
The completed projects are as follows:
· no. 960 « Extension for eco-profit »,
· no. 3508/26.09.2003 « Complex capitalization technology of the dejects from the
animal farms for sustainable agriculture promotion in Romania »,
· no. 3.527/27.09.2003 « Consortium of rural development and extension ».
Also, the beneficiary institutions of the projects have presented to APCP-PMU and
ASSP-PMU, for approval, the Final Reports issued at the closing of the financial cycle.

The analysis of the Final Reports has showed that the objectives were met, according to
each financing trance.

Under the activity of demonstration the modern and ecologic grazing technologies, there
were inventoried the communes' requests, and pastures rehabilitation projects were
designed for their transformation in grazing lands which will allow grazing management.
For the implementation of this program the necessary materials, consisting in fencing
items and seeds, were procured according to the calculations made for each requesting
commune and approved by the Project Local Coordination Committee. The area included in
this program is of about 280 ha. The communes started the construction of the fences
around the pastures, using the materials provided by the Project and the labor by the
communes. The land preparation and the seeding is planned for the year 2006, according
with the best period for each type of seed.

The survey regarding the use of the environment friendly agricultural practices, promoted
under the Project, has highlighted the lack of instruments and knowledge for elaborating
and using of the Nutrients Management Plans, both among local specialists and farmers.
Therefore it was agreed with the Bank that the Project will hire a consultant to elaborate
procedures for design and implementation of the Nutrient Management Plans at the farm
level. The PMU has prepared the Terms of reference for this activity and the contract
selected and contracted. The first draft of the Field Notebook for the Farm level Nutrient
Management Plan was prepared. The final term for the service, that includes the preparation
of the Nutrients Management Plans for 7 farms in the Project area and training of the
OJSPA's and OJCA's staff, is May 2006.


C. Integrated management of Boianu-Sticleanu Polder

The main activity was related to final approval of the Conservation management plan of
the Iezer-Calarasi nature reserve, as well as its exploitation regulation.

According with the legislation in force, the two documents, elaborated by the Consultant
hired under the Project and endorsed by the EPA Calarasi and the Custodian of the
protected area, were sent to the Romanian Academy in order to be reviewed and
approved by the Commission of Nature Conservation and Natural Areas Protection.. The
answer received was envisioning the correctness of it's issuing, but the lack of realism,
having in view the very low financial resources of the Custodian of the Iezer-Calarasi
nature reserve (APSA Iezer-Calarasi), recommending it's reissuing. Therefore, the two
documents have been revised by EPA Calarasi, and been sent, by APCP-PMU, for
approval to the Romanian Academy as well as to the specialized department under the
MEWM.

Also, there was elaborated the list of equipment considered to be necessary, together with
the detailed technical specifications. Those equipments will be used by the EPA Calarasi
and the reserve Custodian, SC Piscicola Calarasi for the activities related to the

management of the protected area. The PMU will get to the agreeing of this list and
procuring the eligible equipment, after the final approval of the Management Plan.

D. Strengthening the capacity of water and soil monitoring and of the environmental
factors at Clrai County level.

With regards to strengthening the institutional capacity in Clrai, regarding water and
soil monitoring and the agricultural environment impact, the Project supported the
participation of the staff from the County Office for Pedological and Agrochemical
Studies (OJSPA) and the Water Management Department (SGA) to the training sessions
related with the Nitrate Directive implementation.

The water quality monitoring program is being carried out by SGA, whom is doing
timely measurements in the piezometers, wells and surface water sections whom form the
monitoring network. The problems encountered were related to the important number of
piezometers deteriorated or entirely destroyed and the impracticable access roads due to
the frequent heavy rains.

Another important activity carried on in the reported period was related to the support
requested by the MEWM for implementation of the Nitrate Directive.
Thus, in accordance with the provision of the Common Order 296/2005 issued by the
MEWM and MAFRD, regarding the approval of the Framework Action Program for the
Preparation of Action Programs in Nitrate Vulnerable Zones, Romania needs to
elaborate, before its accession in the EU, Local Action Programs for the reduction of
nutrients. The Action Programs for vulnerable areas should be elaborated based on
precise diagnoses identifying the different sources of nitrate pollution from agricultural
activities (crop and livestock) and recommending measures for controlling them. For this
reason, there is an urgent need for elaborating a frame methodology for developing
Diagnosis of the vulnerable or potentially vulnerable areas.

Having in view the above, the PMU prepared TORs for consulting services related to the
preparation of a methodology for developing the Diagnosis of the vulnerable or
potentially vulnerable areas and use of the developed methodology for preparing the
Action Programs for vulnerable or potentially vulnerable areas in Clrai, as a
demonstration that could help for replication at the river basin level. A consulting firm
was contracted to perform this service. It is estimated that the final diagnosis as well as
the action plan for Calarasi County will be finalized by March 2006.

Component 2: Strengthening the national regulatory capacity regarding the
environmental policy.

This component of the Project supports, among others, the Ministry of Environment
and Water Management and Ministry of Agriculture, Forests and Rural Development, for
application of the Nitrate Directive (Directive no. 91/676/EEC) in Romanian agriculture.

A major risk for the appropriate application of the Nitrates Directive is that the local
implementing agencies (at county level) may be unable to attract and retain qualified
staff.
One solution to assure an adequate professional expertise for the professionals from the
local agencies involved in the implementation and monitoring of the provisions of the
Nitrates Directive, is to provide them with training and career development benefits
consisting on certificates endorsed by the Ministry of Education and Culture, attesting
their quality as professionals in monitoring and implementation of Nitrates Directive in
Romania. In this regards, in the period September-October 2005, the Project organized a
number of three training sessions, destined to the staff of the three county level
institutions, grouped on regions. There were trained of number of 153 specialists from all
counties in the country. The training sessions have proved to be a great success,
numerous requests for continuation and for extension toward other institutions involved
in the monitoring and/or application of the Nitrate Directive (DADR, PHD, EPA, etc.),
being received. All trainees, whom were declared as admitted after the individual
examinations, received diplomas endorsed by the Ministry of Education and Research.

One of the Key Actions established during the midterm review mission of the APC
Project conducted during January 24-28, 2005, refers to editing and distribution by the
Ministry of Environment and Water Management of a second edition of the "Code of
good agricultural practices for water protection against pollution with nitrates from
agricultural sources" elaborated within the APC Project. Having in view the feed back
received from the stakeholders (farmers, farmers associations, agricultural institutes,
Romanian Academy for Agricultural and Soil Sciences, Ministry of Agriculture,
Forests and Rural Development (MAFRD) etc.) the second edition of the Code includes
both stakeholders' suggestions and the changes incurred in the Romanian and E.U.
legislation.
The revision was done in the period August-November 2005 and the Code has been
revised considering the legislative changes and the agro-economic policy at the European
Union level, by the same firm whom edited its initial version.
The Code has been approved through Common Order no. 1182/22.11.2005 respectively
no. 1270/30.11.2005, issued by MEWM and MAFRD, following to be printed in a
limited number during year 2006.

At the same time, in order to respond to the National Program for Agro-Environment and
create the premises for the access of the farmers and farmers' associations to the
compensations offered within the E.U. programs for those complying with good agro-
environment conditions, the use of a "Code of Good Agriculture and Environment
Condition (CGAEC)" and a "Code of Best Farming Practices (CBFP)" is becoming a
must.
In this respect, the MEWM requested the Project's support for consulting services
regarding the reviewing of the existing documentation and elaborating the three above
mentioned documents. The contents of the codes were approved by the Inter-ministerial
Commission for Applying the Action Plan for Waters Protection against Pollution with
Nitrates from Agricultural Sources, and the TORs for this assignment were prepared by
the PMU.


The "Code for good agriculture and environment condition" was prepared in the period
August-November 2005 and has been approved by both ministries involved in its
elaboration and interpretation, through address no. 6172/22.11.2005, respectively no.
1268/LAV/25.11.2005, issued by MAFRD, respectively MEWM.

As regarding the "Code of best farming practices", it is under preparation and the initial
version of this code will be transmitted to APCP-PMU at the beginning of year 2006.

Component 3: Public Awareness and Replication Strategies

The Projects supports the efforts of public awareness:
(i)
In Clrai County, in order to familiarize the population and to help inducing
behavioral changes necessary for the success of the Project, in the seven
communes selected and replication in the Project area;
(ii)
At national level, in order to disseminate the information regarding the
benefits of the Project activities and promoting the replication at national
level; and
(iii)
At regional level, in the Back Sea neighboring countries, for promoting the
pilot Project as a possible replication model.

Public awareness and replication in Clrai County:

The public awareness campaign at local level is being implemented by Media Promotion
Services firm according with the working plan for year 2005 approved by the Bank. The
Project's objectives and results have been disseminated through activities organized in
the communes both from the Project area and the Calarasi County. The activities were
supported with promotional materials distributed to the participants to different contests
on environmental friendly agricultural practices themes.
The staff of the County Centre for Agricultural Consultancy and other local institutions
(OJCA, SGA, PHD, County Council) was invited to participate in all organized activities
and events thus becoming an important mean with regards to encouraging the adoption of
the good agricultural and environmental practices in the entire county.

Public awareness activities and replication strategy at national level:

The selection of the company who will implement the awareness campaign at national
level was completed and the contract signed by September 2006.
The communication strategy and the action plan for the next period were elaborated and
agreed and the first activities have been started according to it.

Regarding the replication strategy at national level, the Government has identified three
areas (South, North-East, North-West) considered as vulnerable, for the implementation
of the Nitrate Directive, areas where the Project can be replicated.


The data regarding the agricultural practices, the use of the water sources, manure
management practices and the support needed by the local institutions to strengthen their
capacity to implement the Nitrate Directive, have been gathered and, presently, are being
interpreted in order to prepare the Conceptual Note for a future Project, with similar
objectives and which may cover aprox. 20 counties located in the areas afore mentioned.

Public awareness activities and replication strategy at regional level:

The Project team participated to the international ECA meeting, regarding the nutrient
management in the Danube, Black Sea and Baltic Sea riparian countries, organized in
Georgia in the period 28.09.2005 ­ 10.10.2005.
With this occasion the Romania delegation has presented the monitoring results achieved
during the Project's implementation, as well as the general approach regarding the
control of pollution with nitrates from agricultural sources in the vulnerable and
potentially vulnerable areas in Romania.

Component 4: Project Management Unit:

The Project supports a Project Management Unit (PMU) established at the DADR
Clrai headquarters. The PMU comprises the PMU Director, the Technical Specialist
(whom is also supporting the monitoring and evaluation part of the Project), the Financial
Management Specialist, the Accountant, the Secretary/Translator and the Driver.

Regarding the Project implementation monitoring, PMU supervises all the Project
activities ­ construction works, demonstrations, tree planting, water and soil quality
measuring, manure management. PMU meets regularly with the local representatives and
the farmers from the Project area, in order to evaluate the Project impact on the
beneficiaries. The monitoring and evaluation data base is being kept updated by the
PMU. The achievements of the Project monitoring activities are included in the progress
reports, issued periodically. There have been issued monthly reports regarding the
Project's daily implementation, quarterly reports regarding the financial management and
procurement under the Project (PMR), as well as half-yearly progress reports.

The Project's financial auditing has been carried-out by an independent firm, approved
by the World Bank. After the financial audit performed, the report has emphasized a
professional, correct and legal financial management system.

Another permanent activity was the adaptation, improvement and development of the
Project's financial management system. Following the legislation changes in the
financial-accounting area, but also due to small changes performed to the Project's
financial management system, the PMU specialists have elaborated an improved FMIS of
the Project, capable of automatic generation of a greater number of reports of high
complexity.

Also, the PMU has organized several meetings with the beneficiaries and the Local
Coordination Committee to discuss issued related with the Project implementation. A

meeting of the Local Coordination Committee took place in December 2006 with the
purpose of discussing the current problems intervened during Project implementation,
decision making under some activities for whom the funds have proved to be insufficient
for their whole funding, as well as for discussing and approving the implementation plan
for the year 2006.

Year 2005 has represented the fourth implementation year for the "Agricultural Pollution
Control Project", and it was marked by the beginning of discussions regarding the start of
the preparation faze of the Environment Management Project, a new project assisted by
the World Bank whom intends to be implemented at national level, by replicating the
experience gained under the implementation of this pilot Project.

The discussions were carried in an organized background, during months of October,
November and December 2005, between the representatives of the World Bank, Ministry
of Environment and Waters Management, relevant institutions from national level and the
Agricultural Pollution Control Project Management Unit, their summary as well as the
conclusions drawn are being summarized in the World Bank's Aide Memoire from
October 5, 2005.

As result of the common analysis enterprise by the representatives of the Government
and the World Bank, regarding Romania's priorities in the area of environmental
protection, there was realized an initial proposal regarding the activities and the
approximate value of the new Project, this being summarized in the Concept Note from
October 17, 2005.

Regarding the implementation in Romania of the Nitrate Directive the PMU staff has
participated to several working meetings of the Water Basin Committees organized at the
end of year 2005, having as objective the common analysis and the application of the
legislative provisions regarding the control of pollution with nitrates from agricultural
sources. Also, the project's representatives have participated to all the meetings of the
Interministerial Commission ensuring the support, by the performed activities, to the
achievement of the actions comprised in the National action plan for water protection
against pollution with nitrates from agricultural sources.

Evaluation missions

During the month of November 2005, the World Bank carried out a supervision mission
of the Project. With this occasion there were analyzed the results obtained from the last
supervision mission, the general Project progress being appreciated as Satisfactory.




Status of Implementation Progress

This project progress report aims to provide information on:

a. Physical progress of the Project, in which information is given on procurement
activities referring to bid invitations, contract awards, bidding in progress, as
presented by the tables on procurement packages, for consulting and for delivery
of goods, already implemented or being implemented.

The planning of project activities shows in details the Project Implementation
Plan for the second part of the year 2005 as approved by the PCC in its last
meeting of May 27th, 2005, including activities agreed with the Bank during the
Mid-term evaluation mission of January 2005, or requested by the Project
Beneficiaries during the meeting with the PCC.

b. Financial progress of the project, which contains full financial and accounting
information on status of contract payments, disbursements from the Grant
Account, disbursements from the Special Account, overall Project payments,
accounting on a contract by contract basis and by category of procurement and of
expenditures.

Note 1: The ecological restoration of part of the Calarasi ­ Raul Polder to the initial conditions (before
building the dike and transformation into an agricultural polder) is not possible anymore due to the
modification of the hydrological conditions of the Danube course. It was agreed with the Bank that
the amount budgeted for the implementation and monitoring of the ecological restoration project for the
Calarasi ­ Raul Polder would be reallocated to other project components
